By accessing or using VCM.fyi, including the website at vcm.fyi, the application at app.vcm.fyi, the newsletter at news.vcm.fyi, and any related services (collectively, the “Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Description of Service

VCM.fyi is a carbon market intelligence platform that provides data aggregation, AI-powered analysis, and market intelligence for the voluntary carbon market. The Service includes:

A project database aggregating data from major carbon credit registries (Verra, Gold Standard, ACR, CAR, Isometric, Puro.earth)
AI-generated weekly intelligence reports on carbon projects, country policies, and market developments
A weekly email newsletter with market analysis
Buyer discovery and analytics tools
Country policy tracking
An AI research assistant

3. AI-Generated Content

A significant portion of the content on VCM.fyi is generated or augmented by artificial intelligence. This includes, but is not limited to, project intelligence memos, risk assessments, price narratives, country policy summaries, newsletter content, and proponent analyses.

AI-generated content may contain errors, inaccuracies, hallucinations, or outdated information. While we implement safeguards including automated deduplication, date filtering, and editorial review, no AI system is infallible. You should independently verify any information obtained through the Service before making decisions based on it.

4. Not Investment, Financial, or Legal Advice

Nothing on VCM.fyi constitutes investment advice, financial advice, legal advice, or any other form of professional advice. The Service provides information and analysis for informational purposes only. VCM.fyi does not recommend, endorse, or advise for or against any particular carbon project, credit, registry, methodology, or transaction. Mention of any project, proponent, or organization does not constitute endorsement or criticism.

5. No Warranty; Disclaimer of Accuracy

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VCM.fyi does not warrant that:

The information provided is accurate, complete, current, or error-free
The Service will be uninterrupted, secure, or free from bugs
Any specific result will be achieved through use of the Service
Registry data reflects real-time status (data is synchronized daily and may lag)
AI-generated analysis correctly interprets or attributes information to the right entities

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VCM.FYI AND ITS OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF VCM.FYI EXCEED THE AMOUNT YOU PAID TO VCM.FYI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

7. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hi@vcm.fyi of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice.

8. Subscription and Payment

VCM.fyi offers both free and paid tiers. For paid subscriptions:

Fees are charged in advance on a monthly or annual basis as specified at the time of purchase
All fees are non-refundable except where required by law or at our sole discretion
We reserve the right to change pricing with 30 days' notice
Failure to pay may result in suspension or termination of your access
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period

9. Intellectual Property

All content on VCM.fyi, including text, data compilations, graphics, AI-generated analysis, software, and the overall look and feel of the Service, is owned by or licensed to VCM.fyi and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your own internal business purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Service without prior written permission.

Underlying registry data (e.g., from Verra, Gold Standard) remains the property of the respective registries and is subject to their terms of use.

10. Corrections and Error Reporting

VCM.fyi is committed to accuracy. If you identify an error in any content — including AI-generated intelligence, project data, country policy information, or newsletter content — please report it to hi@vcm.fyi.

We will investigate all reported errors and, where appropriate, issue corrections promptly. For significant errors in published newsletters, we will publish a correction notice to our mailing list. See our Editorial Policy for more details.

11. Third-Party Links and Data

The Service may contain links to third-party websites, including carbon registry websites, news sources, and other external resources. VCM.fyi is not responsible for the content, accuracy, or practices of any third-party sites. The inclusion of any link does not imply endorsement.

12. Indemnification

You agree to indemnify and hold harmless VCM.fyi and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
